Does the CRA apply to my product?

Pick "Not sure" when you do not know yet; the result lists it as an open question.

01 Background

The CRA in brief

What it covers

Products with digital elements made available on the EU market: hardware and software whose intended or foreseeable use includes a data connection to a device or network, subject to the regulation's scope and exclusions. Remote data processing is covered only as part of such a product, so pure SaaS is generally not itself in scope.

What is excluded

Products covered by specific sector rules, such as medical devices, motor vehicles, civil aviation and marine equipment, products developed exclusively for national security or defence, and free software not supplied in the course of a commercial activity.

Who carries obligations

The manufacturer carries most of them. Importers and distributors check that the manufacturer met its obligations before making the product available. Open-source software stewards have a lighter regime.

When it applies

  1. in force
  2. conformity assessment body provisions
  3. reporting obligations
  4. main obligations

CE marking

Products in scope carry CE marking after the applicable conformity assessment: for most products the manufacturer's own assessment, for some important and critical products a third-party one. ProveStack does not grant CE marking; a dashboard cannot grant conformity.

Preliminary orientation only, not legal advice, not a conformity assessment and not a certification. Confirm scope with qualified counsel.

Inside ProveStack, each assessment is stored with its answers, author and time, and its obligations become tracked items with a human applicability decision.
